In addition to the proposed rules announced last week, the New Hampshire Department of Agriculture, Markets, and Food (Department) has announced additional proposed rules to incorporate changes required by 2021’s HB 2.

These amendments to the regulations on the Transfer of Animals and Birds include:

  • An increase in the number of dogs transferred in a year that requires a person to be licensed as a “pet vendor” in New Hampshire, from 25 to 30.
  • A clarification of the definition of “primary enclosure” to allow for structures with four or more sides.
  • A declaration that waste shall be removed from animal facilities as often as necessary, but no less than once daily unless otherwise specified in the written animal health program.
  • A new part for the “Transfer of Dogs, Cats, or Ferrets from One Owner to Another”, which describes the obligations and certifications required of NH-licensed veterinarians in creating an Official Certificate of Transfer in the new statewide electronic animal records database.

The American Kennel Club (AKC) encourages all New Hampshire dog owners to review the proposal and to provide the New Hampshire Department of Agriculture, Markets, and Food with comment on how the details of the rule may impact them.  The Department will conduct a public hearing on this proposal at 9AM on Monday, June 24, 2024.  The hearing will be conducted at the Office of the Commissioner, One Granite Place, Suite 211, Concord, New Hampshire 03301.  The Department is also accepting public comments on the proposal through Tuesday, July 2, 2024.  Comments may be emailed to Patricia L.
